Dare One Sue a Rothschild?

Dear Counselor:

   A couple of American con men talked a French multi-billionaire, Gregoire de Rothschild, into putting up $177,000,000 in exchange for a piece of a start-up called Conundrum Capital.  (Yes that was the name.  No I'm not making it up.) (Lately there's a whole new company called Conundrum.  Is it the same?  Is it a smoke screen?)

   But it was a scam.  Behind Rothschild's back they looted the so-called company out of the entire $177,000,000, but they did it legally. It seemingly wasn't a theft but a corporation that failed because of mismanagement.  Rothschild had to swallow the whole $177,000,000.

   Now I don't care how rich you are, you have to feel a $177,000,000 burn.  Rothschild certainly did. He was ready for war.

     

   Because French-speaking Rothschild's English is poor he hired an American freelance journalist and author, Frederick Lembeck (me), to draft all the paperwork and above all, to deliver the kind of high-end PR copy he needed, WHICH LEMBECK DID DELIVER.  Samples of the top-drawer stuff he delivered are available to show to any and all jurors. 

   

   In exchange he promised Lembeck 10% of the $177,000,000, or $17,700,000!
(You must know some freelance writers. Ask them when was the last time someone offered them $17,700,000!)

   But it was bullshit. Rothschild's data was BS and the two crooks rolled on the floor laughing. Rothschild's case went nowhere and Lembeck, in turn, was paid NOTHING, not so much as lunch money and carfare home.

 

   Now in fairness, Lembeck and Rothschild never agreed on a kill fee.  Nor was anything in writing.   (As you may know, business with freelancers is always by word-of-mouth only.  No one ever draws up paperwork.)  It never occurred to Lembeck that a Rothschild would turn out to be BS so he and Rothschild never discussed a kill fee.

   So now the question is, are there grounds here for a lawsuit? Rothschild is smugly assuming the absence of a written agreement leaves him invulnerable to a lawsuit. Is he right?  Will a jury of hard-working Americans sympathize with the working man (freelance writer) who got stiffed or the multi-billionaire who's being a creep?

   Would you like to take this case?  I think we should ask the jury for $600,000,000.00.  What the hell. 

 

   My hunch is that we need only file the paperwork and the resulting publicity will make them want to settle quickly and quietly.  They're in the wrong and they know it.
